# AI Photo Cleaner: Clean Up
Photo & Email Cleaner for iPhone
This agreement is presented in-app as "Terms of Use".

## 1. Introduction
This User Agreement (hereinafter the "Agreement") is a legally binding agreement between you and AI Photo Cleaner: Clean Up (hereinafter the "App" or "we"/"us"), and applies to your downloading, installation, and use of the App.
Please read this Agreement carefully before using the App. **By downloading, installing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by all terms of this Agreement.** If you do not agree to this Agreement, please do not use the App and remove it from your device.

## 2. Changes to This Agreement
We reserve the right to modify this Agreement at any time. Any revised version will be posted within the App with a new effective date. Your continued use of the App after a revised version is published constitutes your acceptance of the modified Agreement. We recommend that you review this Agreement periodically to stay informed of the latest version.

## 3. Age Requirements
To download, install, access, or use the App, you must be at least **13 years old**.
**Minors between 13 and 17 years old** must use the App with the permission and under the direct supervision of a parent or legal guardian. If you fall within this age range, before taking any of the actions above, you must: (a) confirm that your parent or guardian has read and agreed to this Agreement; and (b) have the right to enter into a binding contract with us and not be prohibited from doing so under any applicable law. Parents or guardians are responsible for the minor's use of the App.
**No one under 13 years old may download, install, access, or use the App.**
By using the App, you confirm that you meet the above age requirements, or that you have obtained the consent of your legal parent or guardian, and that you are fully capable of complying with all terms and obligations set forth in this Agreement.

## 4. App Features
The App is a storage cleanup tool for iPhone. It mainly helps you: clean up redundant photos and videos (duplicates / similar / blurry / screenshots / Live Photos / videos, etc., with one-tap cleanup, swipe cleanup, and video compression), organize contacts (merge duplicates / delete incomplete ones / local backup), and clean up mail (connect to Gmail via Google authorization and process by sender in batches).
Except for mail cleanup, which requires communicating with Gmail through Google's official API, all other scanning, identification, compression, and processing are performed locally on your device; your photos, videos, contacts, and email content are not uploaded to any of our servers.

## 5. Privacy Policy
We take your privacy very seriously. For details on how the App handles user data, please refer to the *Privacy Policy*. Your continued use of the App indicates your agreement to the terms of the Privacy Policy.

## 6. System Permissions and Account Authorization
Some features of the App require you to grant the corresponding permissions:
- **Photos access**: used to scan and clean up photos and videos.
- **Contacts access**: used to identify and organize contacts.
- **Google account authorization (Gmail)**: used to connect to your Gmail mailbox and perform mail cleanup. The App obtains access through Google's official OAuth 2.0 authorization mechanism and **neither accesses nor stores your Google account password**.
You may revoke the above permissions at any time in your iOS system settings or Google account settings. After revocation, the corresponding features will become unavailable, but this will not affect your use of the App's other features.

## 7. Important Notes on Deletion Operations
**Please confirm the selected items before performing any deletion or merge operation.** The App only carries out operations according to your instructions; the final decision and responsibility rest with you.
- **Photos / Videos**: deleted items are moved to the "Recently Deleted" album in the Photos app, where they are **kept for 30 days** and can be recovered; once permanently deleted from there or after 30 days, they are permanently deleted. If iCloud Photos is enabled, the operation syncs across all your devices; freed storage is only released after items are permanently cleared from "Recently Deleted".
- **Contacts**: merging and deleting **cannot be undone**; if your account is an iCloud account, the operations sync to iCloud. **We strongly recommend using the App's built-in backup first.**
- **Mail**: "deleting" in the App means **moving the email to the Gmail Trash** (recoverable in Gmail); it is **not permanently deleted**. Some senders do not support automatic unsubscribe.
- **Video compression**: image quality will suffer some loss after compression; whether the original video is kept depends on the "**Keep Original**" toggle—when **on (default)** the original stays in the Photos app, and when **off** it is moved to "Recently Deleted" (recoverable within 30 days).

## 8. Prohibited Conduct
When using the App, you must not:
- Use the App for any unlawful purpose
- Access another person's photos, contacts, or mailbox without authorization
- Infringe the intellectual property rights or other lawful rights and interests of others
- Decompile, reverse engineer, modify, or crack the App
- Transfer, sublicense, sell, or distribute the App or any part of it
- Use the App to commit fraud, harassment, or other malicious acts
- Interfere with or disrupt the normal operation of the App in any way
- Use automated means to make large-scale calls to the third-party APIs on which the App relies

## 9. App Availability
The App requires **iOS 17.0 or later**. We do not guarantee that the App is fully compatible with all devices, nor do we guarantee uninterrupted or completely error-free operation of the App. You may uninstall the App from your device at any time.
The mail cleanup feature relies on the Gmail API provided by Google. If that service is changed, interrupted, or becomes unavailable, the corresponding feature may be affected, and we assume no responsibility for this.

## 10. Subscription Terms
### 10.1 Subscription Plans
The App offers a paid subscription, **Clean Up Pro**, with plans of different durations (such as weekly and yearly), and may include a free trial. **The specific plans, prices, free-trial duration, and regional differences are as shown on the App Store checkout page.**
### 10.2 Automatic Renewal
Your subscription will renew automatically before it expires, and the charge will be deducted from your Apple ID account. To turn off automatic renewal, go to iOS "Settings" → "Apple ID" → "Subscriptions" and turn off automatic renewal **at least 24 hours** before the end of the current subscription period. After cancellation, you may continue to use Pro features until the end of the current subscription period.
### 10.3 Free Trial
Your first subscription includes a 7-day free trial. After the free trial period ends, you will automatically be charged for the selected plan, **unless you cancel the subscription 24 hours before the trial ends**.
### 10.4 Payment and Restore Purchases
All subscriptions and payments are processed through **Apple In-App Purchase** and are subject to Apple's Terms of Service. We do not directly process any payment information.
If you switch devices or reinstall the App, you can restore your existing subscription via "Settings → Restore Purchases".
### 10.5 Refunds
Refunds are handled by Apple in accordance with its policies; please apply through Apple's support channels. We are not able to process refunds directly for you.

## 11. Intellectual Property
The App and all content it contains (including but not limited to text, graphics, interface design, and code) are protected by intellectual property laws and are owned by us.
This Agreement does not grant you any intellectual property license. You are granted only a limited, non-exclusive, non-transferable personal right to use the App under the terms of this Agreement.

## 12. Disclaimer
The App is provided on an "**as is**" and "**as available**" basis, and we make no express or implied warranties as to the following:
- That the operation of the App will be uninterrupted or error-free
- The complete accuracy of scanning and identification results (for example, the determination of "duplicate", "similar", or "blurry", as well as the selection of the "best photo", are all algorithmic recommendations, and **the final deletion decision is yours to make**)
- The absolute accuracy of values such as "space that can be freed" and "estimated space savings" shown in the App (these are all **estimates**)
- The complete compatibility of the App with all iOS devices and system versions
- The availability and stability of third-party services (Apple, Google)

## 13. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, or consequential losses arising from the use of or inability to use the App, including but not limited to **data loss**, loss of photos or videos, loss of contacts, loss of emails, loss of profits, or business interruption.
In no event shall our total liability exceed the total amount of fees you paid to the App in the 12 months preceding the claim.

## 14. Termination
If you violate any term of this Agreement, we have the right to immediately terminate your right to use the App. Upon termination, you must stop using the App and delete it from your device.
Termination does not affect any rights or obligations that arose prior to termination. Subscription fees you have already paid will not be refunded on account of termination (refunds are still handled in accordance with Apple's policies).

## 15. Governing Law
This Agreement is governed by applicable laws and regulations. If any provision of this Agreement is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in effect.
